eSIM.day TERMS OF SERVICE
1. Introduction and Acceptance
For the purposes of these Terms, "eSIM.day", "we", "us", and "our" refer to the Homura Network contracting entity applicable to your purchase or Service, as identified on the relevant invoice, order page, service schedule, or written agreement.
Where no other entity is expressly identified, the contracting entity is Homura Network Limited, a company incorporated in Hong Kong and operating eSIM.day under the registered business name ESIM DAY (Business/Branch Registration No. 75553711-002).
"You", "your", and "customer" refer to the individual or legal entity that creates an account, places an order, purchases, activates, accesses, or uses an eSIM.day Service. If you purchase or use a Service on behalf of an organisation or other legal entity, you represent that you have authority to bind that entity to these Terms.
"Service" or "Services" means the digital eSIM profiles, mobile data connectivity, Store Credit, eSIM.day App, customer platform, and related services made available through eSIM.day.
"Plan" means the specific mobile data package selected by the customer, together with the specifications and conditions stated on the applicable product or purchase page.
By creating an account, placing an order, making payment, installing or activating an eSIM, accessing the eSIM.day App or customer platform, or otherwise using a Service, you agree to be bound by these eSIM.day Terms of Service ("eSIM Terms").
If you do not agree with these eSIM Terms, you must not purchase, activate, access, or use the Service.
2. Scope and Related Terms
These eSIM Terms provide the primary contractual terms applicable to eSIM.day Services.
Plan-specific conditions stated on the applicable product or purchase page, including supported destinations, activation rules, data allowances, validity periods, network information, speed conditions, Fair Use Policies, and technical restrictions, form part of the applicable Plan terms.
In the event of a direct conflict, an individually executed written agreement or service schedule will prevail, followed by specific terms stated on the applicable product or purchase page, followed by these eSIM Terms.
The general Homura Network Terms of Service apply only on a supplementary basis to matters not expressly addressed by these eSIM Terms. They do not override these eSIM Terms or applicable Plan-specific conditions.
Personal information is handled in accordance with the applicable Privacy Policy.
3. Nature of the Service and Network Provision
eSIM.day provides digital eSIM and mobile connectivity services. Services may be delivered through third-party telecommunications platforms, mobile network operators, international roaming partners, network aggregators, and other network service providers.
Unless otherwise expressly stated, eSIM.day is not the underlying mobile network operator ("MNO") and does not directly own or operate the applicable radio access network.
Network coverage, available operators, frequency bands, radio technologies, roaming arrangements, network capacity, routing, traffic management, and other network conditions are determined or managed in whole or in part by applicable telecommunications providers.
Unless otherwise expressly stated on the applicable product page, all eSIM.day Plans are data-only services and do not include a conventional telephone number, cellular voice calling, SMS/MMS messaging, or emergency calling functionality.
You must not rely on a data-only eSIM as your sole means of contacting emergency services.
4. Network Availability, Technology, Speeds, and Changes
Available mobile network operators, roaming partners, frequency bands, radio technologies, and other network configurations may change from time to time.
References to a particular operator, network name, 4G, LTE, 5G, coverage level, advertised speed, maximum speed, or similar network capability indicate supported or generally available capabilities only. They do not guarantee that the same operator, radio technology, signal strength, network configuration, or connection speed will remain continuously available.
Actual network availability and speeds depend on factors including your device, location, coverage, signal conditions, network congestion, roaming arrangements, network configuration, Fair Use Policy, traffic-management measures, and other prevailing network conditions.
Unless expressly stated otherwise for the applicable Plan, eSIM.day does not guarantee any minimum or continuously available upload speed, download speed, latency, signal strength, or radio technology.
Applicable telecommunications providers may add, remove, restrict, replace, or modify operators, roaming arrangements, radio technologies, routing, traffic-management measures, or other network configurations due to technical, commercial, regulatory, security, or operational requirements.
eSIM.day may make reasonable technical or configuration changes where necessary to maintain connectivity, comply with provider requirements, respond to network or security changes, or continue providing the applicable Plan.
A change in operator, network technology, routing, IP location, speed, or other technical configuration does not by itself constitute a failure of the Service where materially functioning mobile data connectivity continues to be provided for the applicable destination.
5. Network Routing, IP Geolocation, and Third-Party Services
Mobile data may be routed or rerouted through telecommunications gateways, core networks, upstream providers, or Internet breakout points located outside your physical location.
Public IP addresses, IP geolocation, routing paths, Internet breakout locations, and upstream providers may therefore differ from your physical location and may change during the validity period of a Plan.
Unless otherwise expressly stated, eSIM.day does not guarantee a particular public IP address, IP geolocation, routing path, Internet breakout location, or upstream provider.
eSIM.day provides mobile data connectivity and does not control third-party websites, applications, platforms, or Internet services.
Unless expressly stated on the applicable product page, we do not guarantee the availability or functionality of any particular social-media platform, messaging application, banking service, streaming service, gaming service, VPN, or other third-party Internet service.
Availability may be affected by IP geolocation, routing, local restrictions, third-party policies, account status, device settings, or other circumstances outside our reasonable control.
Inability to access a particular third-party service does not by itself constitute a failure of the eSIM.day Service where mobile data connectivity otherwise materially functions.
6. Account, Electronic Delivery, and Finality of Purchase
eSIM products are intangible digital telecommunications products delivered electronically.
The primary email address provided during checkout or registered to your account is the primary delivery destination for eSIM QR codes, activation codes, SM-DP+ information, APN configurations, installation instructions, and other Service-related communications.
An eSIM will normally be considered electronically delivered when the applicable credentials or installation information have been dispatched to the email address provided by you or made available through your authenticated eSIM.day App or customer portal.
Once electronic delivery has occurred, the order is considered fulfilled for delivery purposes and the purchase is ordinarily considered final.
This does not depend on whether you subsequently open the email, view or scan the QR code, install the profile, activate the Plan, travel to the applicable destination, or commence data usage.
Where credentials are materially incorrect or unusable because of an error attributable to eSIM.day or an applicable telecommunications provider, or where another qualifying Service failure is verified, the matter may instead be handled under Section 18.
You are responsible for providing accurate and accessible account and delivery information, maintaining access to your registered email account, checking applicable spam or filtering systems, and protecting eSIM credentials against unauthorized disclosure or use.
Where incorrect delivery information has been provided, you should contact support promptly. Subject to verification and technical availability, we may attempt to correct the information, resend credentials, or provide a replacement.
Replacement is not guaranteed where credentials have already been delivered, accessed, disclosed, installed, or used.
eSIM.day Services do not support transfers between customer accounts unless expressly agreed otherwise.
7. eSIM.day App and Customer Platform
eSIM.day may provide an official mobile application, website, customer portal, or other digital interface through which customers may access or manage certain Services.
Depending on the Service, device, location, and software version, available functions may include purchasing Plans, accessing installation information, viewing Plan status and usage information, managing Store Credit, reviewing orders, managing account information, and contacting customer support.
Available functions may vary by device, operating system, App version, location, Plan, or technical availability. Features may be added, modified, suspended, or discontinued from time to time.
Usage information displayed through the App or customer platform is provided for convenience and may be subject to normal telecommunications reporting delays. Where displayed usage differs from telecommunications records supplied by the applicable provider, those provider records will ordinarily be treated as authoritative.
Subject to these eSIM Terms, eSIM.day grants you a limited, personal, non-exclusive, non-transferable, and revocable licence to use the official eSIM.day App solely for accessing and using the Services.
You must not copy, modify, distribute, reverse engineer, circumvent, interfere with, or misuse the App, customer platform, or associated security and technical controls.
Certain functionality may require an Internet connection, compatible device, supported operating system, device permissions, or installation of an updated version of the App.
eSIM.day does not guarantee uninterrupted or error-free availability of the App or customer platform. Temporary inability to access the App or customer platform does not by itself constitute failure of an already provisioned Plan where the underlying mobile data Service otherwise continues to function.
8. Orders, Payment, and Anti-Fraud
You must provide accurate and reasonably verifiable billing, contact, and order information when purchasing a Service.
The final amount payable is the amount stated on the applicable checkout page or invoice when the order is submitted.
We may use third-party or automated fraud-prevention, payment-risk, and transaction-monitoring systems.
Where a transaction is identified as potentially fraudulent or unauthorized, we may request additional information or verification before accepting the order or activating the Service.
eSIM.day may reject, delay, or cancel an order where reasonably necessary because of suspected fraud or unauthorized payment, payment or security risk, materially inaccurate information, technical or upstream service unavailability, or an obvious pricing, product, or configuration error.
9. eSIM.day Store Credit
eSIM.day may issue internal store credit ("Store Credit") for use toward eligible eSIM.day Services.
Store Credit may arise from promotional credits, campaigns, customer-service adjustments, goodwill or service compensation, approved refunds, billing corrections, or other credits issued by eSIM.day.
All Store Credit is denominated exclusively in Hong Kong Dollars (HKD) and may only be used toward eligible eSIM.day products expressly priced in HKD, unless otherwise expressly supported.
Store Credit does not accrue interest, cannot ordinarily be transferred between customer accounts, cannot be used to make payments to third parties, and cannot ordinarily be redeemed for cash or withdrawn to an external bank account, payment card, or electronic wallet.
Promotional or other Store Credit may be subject to additional eligibility, product, usage, or expiry conditions disclosed when issued.
The existence or availability of Store Credit does not itself create a right to a refund, compensation, or additional credit.
Where an order paid wholly or partly using Store Credit is approved for a refund, the portion originally paid using Store Credit may be returned exclusively as Store Credit.
Where eSIM.day and the customer agree to issue an approved refund, billing adjustment, service credit, goodwill adjustment, or other monetary accommodation as Store Credit, an amount denominated in a currency other than HKD may be converted into HKD using the applicable exchange or settlement rate at the time the Store Credit is issued.
Once issued, the resulting HKD amount will not subsequently be adjusted because of exchange-rate movements.
10. Device Compatibility and Unsupported Configurations
You are responsible for confirming that your device is compatible with the applicable eSIM and Plan before placing an order.
Your device must be eSIM-compatible, carrier-unlocked, and support the network technologies, frequency bands, and configurations required for the relevant Plan.
Compatibility may vary by exact device model, regional or carrier variant, firmware, operating system, destination, network, and Plan. A device being generally advertised as eSIM-compatible does not guarantee compatibility with every eSIM.day Service.
Unless otherwise expressly stated, eSIM.day does not guarantee compatibility or provide technical support for unsupported, modified, emulated, virtualised, or non-native eSIM configurations, including third-party eSIM or eUICC adapters, modified or unofficial eSIM software, rooted or jailbroken devices, custom firmware, virtualised environments, or unsupported cellular routers, modems, and portable Wi-Fi devices.
Use of an unsupported device or configuration is at your own risk.
Failures resulting from device incompatibility, carrier locking, unsupported hardware or software, or modified configurations are not considered failures of the eSIM.day Service and do not ordinarily qualify for a refund, replacement, Store Credit, extension, or other compensation under Section 18.
11. Installation, Activation, Validity, and Reinstallation
The validity period and commencement of each Plan are governed by the activation policy stated on the applicable product page.
Depending on the Plan, validity may commence upon purchase, profile installation, activation, first successful connection to a supported network, first data usage, a specified calendar date, or another event expressly stated in the product description.
Unless a different period is expressly stated on the applicable product page, an eSIM should be installed and, where applicable, activated within 30 days of purchase.
After that period, eSIM.day does not guarantee that an unused profile will remain available for installation, activation, reissuance, or network registration.
An eSIM profile may be subject to single-installation, device-binding, limited-download, or reinstallation restrictions imposed by the applicable telecommunications provider.
Once an eSIM has been successfully installed, you should not delete or remove the profile unless instructed to do so by eSIM.day support.
If an installed eSIM is deleted, removed, reset, erased, or transferred, eSIM.day does not guarantee that the same profile can be downloaded, reinstalled, reactivated, or used again on the same or another device.
Deletion of an installed eSIM does not ordinarily qualify for a refund, replacement, Store Credit, extension, or other compensation. Where technically available, we may nevertheless attempt to assist with reinstallation, reprovisioning, or replacement.
Failure to install or activate within the applicable period may cause the eSIM or Plan to expire, become unavailable, or otherwise be affected by the applicable provider's rules and does not by itself create a right to a replacement, extension, Store Credit, or refund.
12. Data Usage and Expiration
A Plan expires upon reaching its applicable expiration condition or fully consuming its allocated data allowance.
Unless otherwise expressly stated, unused data does not roll over, has no cash value, and is forfeited upon expiration.
Data usage is measured using telecommunications records generated or supplied by the applicable telecommunications provider or MNO.
Such records will ordinarily be treated as authoritative for usage purposes, subject to correction of manifest technical errors.
Usage information displayed through eSIM.day is provided for reference and may reflect normal telecommunications reporting delays.
13. Acceptable Use
You must use eSIM.day Services in compliance with applicable laws, these eSIM Terms, and the conditions of the applicable Plan.
You must not use, attempt to use, or permit the use of the Services, App, customer platform, account, or eSIM credentials for:
- unlawful, fraudulent, deceptive, abusive, or criminal activity;
- phishing, scams, impersonation, unauthorized account access, credential misuse, or attempts to obtain information or access without authorization;
- malicious network scanning, intrusion, denial-of-service activity, malware distribution, or other activity that may compromise or interfere with a network, system, device, or Service;
- spam, unsolicited bulk messaging, automated or artificial traffic generation, traffic pumping, SIM boxing, telecommunications fraud, bypass, or similar abusive telecommunications activity;
- circumvention of Fair Use Policies, speed or usage limits, roaming restrictions, fraud controls, security controls, or other technical or network-management measures;
- unauthorized resale, rental, redistribution, transfer, or commercial provision of an eSIM profile, credential, or Service; or
- activity that infringes the intellectual property, privacy, or other legal rights of another person.
Normal personal hotspot or tethering use is permitted where supported by the applicable Plan and remains subject to applicable Fair Use, speed, tethering, and network conditions.
You must not knowingly facilitate or assist another person in carrying out prohibited activity through your account, credentials, or Service.
eSIM.day may take reasonable measures to prevent, investigate, restrict, or mitigate suspected fraud, abuse, security risks, or harmful use.
14. Customer Responsibility and Third-Party Conduct
You are responsible for your use of the Services and for maintaining reasonable security of your account, device, and eSIM credentials. You should promptly notify eSIM.day if you become aware of unauthorized access or use.
eSIM.day provides telecommunications connectivity and is not a party to communications, payments, purchases, agreements, or other activities carried out by customers through the Internet.
We are not responsible for fraud, scams, phishing, impersonation, malicious websites or applications, misleading content, unauthorized transactions, account compromise, or other acts or omissions of third parties encountered while using the Service.
You are responsible for evaluating the legitimacy and security of websites, applications, communications, merchants, payment requests, and other third-party services that you choose to access or use.
Any unlawful, fraudulent, abusive, or unauthorized activity carried out by a customer through an eSIM.day Service remains the responsibility of that customer and does not constitute an act, representation, endorsement, or authorization by eSIM.day.
The customer remains responsible for charges, losses, penalties, claims, or other consequences arising directly from their own unlawful, fraudulent, abusive, or unauthorized use of the Service.
15. Plan Speeds, Fair Use, and Network Management
Plans may be subject to Fair Use Policies ("FUP"), high-speed data allowances, speed caps, throttling, traffic-management measures, hotspot or tethering restrictions, reset periods, or other network-management conditions stated on the applicable product page.
A Plan described as "Unlimited" refers to the applicable data allowance structure and does not necessarily mean unlimited high-speed data.
For example, a Plan may provide a specified amount of high-speed data followed by continued connectivity at a reduced or capped speed, or may provide unlimited data subject to a stated speed limit.
References to 4G, LTE, 5G, "high-speed", "up to" a stated speed, maximum speeds, or a stated capped speed such as 1 Mbps describe the applicable Plan conditions or supported network capabilities. They do not constitute a guaranteed minimum or continuously available connection speed unless expressly stated otherwise.
Where a Plan specifies a reduced or capped speed following a usage threshold, the applicable cap forms part of the Plan conditions. Actual experienced speed may nevertheless be lower because of coverage, congestion, device capability, radio conditions, routing, traffic management, or other network factors.
eSIM.day does not guarantee continuous access to the maximum theoretical, advertised, or supported capability of the underlying mobile network.
16. Local Roaming and Telecommunications Restrictions
eSIM.day travel Plans are intended primarily for temporary roaming use.
In some countries or regions, roaming services or foreign mobile devices may be subject to usage-duration limits, permanent-roaming controls, device or IMEI registration, taxes or fees, subscriber-registration requirements, residency requirements, or other telecommunications rules.
Such requirements may vary or change from time to time and may affect continued network access after a particular period of use.
You are responsible for complying with applicable local requirements relating to your device and use of the Service.
Restrictions arising from such requirements do not by themselves constitute a failure of the eSIM.day Service.
17. Travel Changes and Customer Circumstances
eSIM.day provides telecommunications connectivity and does not provide or arrange transportation, accommodation, visas, immigration services, travel insurance, or other travel arrangements.
A change, delay, cancellation, or inability to undertake the intended travel does not ordinarily create a right to cancellation, refund, Store Credit, replacement, extension, or compensation where the purchased Service remains capable of being provided.
This includes circumstances relating to personal or health matters, visa or immigration requirements, denied boarding, transportation disruption, changes in travel plans, or other events that prevent or alter the customer's intended travel.
Where circumstances affecting travel also cause the purchased eSIM.day Service itself to become materially unusable, eligibility for any Service remedy will instead be determined under Section 18.
Customers facing exceptional circumstances may contact eSIM.day support. eSIM.day may provide a goodwill adjustment, Store Credit, extension, replacement, or other accommodation on a case-by-case basis, but such accommodation does not create a contractual entitlement or precedent.
18. Refunds, Troubleshooting, and Service Remedies
Except for remedies or accommodations provided under this Section, purchases that have become final under Section 6 are non-refundable.
The fact that an eSIM remains unused, unactivated, partially used, or technically capable of cancellation or revocation by an upstream telecommunications provider does not itself create a contractual right to cancellation, refund, Store Credit, replacement, extension, or compensation.
A refund or other remedy is not ordinarily available where inability to use the Service results from circumstances not attributable to eSIM.day or a verified failure of the purchased Service. This includes incorrect Plan selection, incorrect customer or delivery information, device incompatibility or carrier locking, unsupported hardware or software, incorrect device, roaming, network or APN configuration, deletion of an installed eSIM, failure to activate within the applicable period, local telecommunications or device-registration restrictions, or limitations affecting third-party Internet services.
If you encounter a suspected connectivity, credential, installation, activation, or provisioning failure, you must contact eSIM.day support promptly during the applicable Plan period and, where reasonably possible, before the Plan expires.
You agree to provide reasonable diagnostic information requested by eSIM.day or the applicable telecommunications provider, which may include device information, carrier-lock status, network and APN configuration, screenshots, error messages, ICCID or EID, and physical location.
Where a material Service failure attributable to eSIM.day or an applicable telecommunications provider is verified, eSIM.day may first attempt to resolve the issue through troubleshooting, reconfiguration, reprovisioning, replacement, or another reasonable technical measure.
Where the verified failure cannot reasonably be resolved, eSIM.day may provide an appropriate remedy having regard to the nature and duration of the failure, the circumstances, and any Service already used. The remedy may include a replacement eSIM, an extension of Service validity, Store Credit, a partial monetary refund, or a full monetary refund.
Unless otherwise expressly agreed, the customer is not entitled to require a particular form of remedy where another reasonable remedy adequately addresses the verified issue.
eSIM.day may also provide a refund, replacement, Store Credit, extension, or other accommodation on a discretionary or goodwill basis where the normal eligibility requirements are not met. Such accommodation does not create a contractual entitlement or precedent.
Where a monetary refund to the original payment method is approved, payment-processing, gateway, currency-conversion, network, or similar transaction charges actually incurred or retained and not returned to eSIM.day may be deducted from the approved refund amount.
Store Credit remains subject to Section 9.
19. Third-Party Sales Channels and App Marketplace Purchases
eSIM.day Services may in some cases be sold, distributed, provided, or billed through an authorised reseller, marketplace, business partner, application marketplace, or other third-party sales channel.
Where a Service is purchased from a third-party seller rather than directly from eSIM.day, the third party may determine the applicable purchase price, currency, payment process, invoice, cancellation procedure, or refund procedure.
Requests concerning payment reversal, billing adjustments, or monetary refunds for such transactions should normally be submitted to the original seller or payment platform.
eSIM.day may provide reasonable technical assistance concerning the underlying eSIM Service but may not be able to reverse, refund, or modify a transaction processed by another merchant.
Where an in-app purchase or subscription is billed directly by Apple App Store, Google Play, or another application marketplace, refund and payment requests may be subject to that platform's applicable payment and refund procedures.
Use of the underlying eSIM.day Service remains subject to these eSIM Terms unless different service terms are expressly stated for the relevant distribution arrangement.
eSIM.day is not responsible for representations, pricing, promotions, payment practices, or other conduct of an independent third-party seller that has not been expressly authorised by eSIM.day.
20. Payment Disputes and Chargebacks
Customers should first contact eSIM.day regarding billing concerns, disputed charges, duplicate payments, or refund requests relating to purchases made directly from eSIM.day.
A payment dispute, claim, or chargeback initiated through a payment provider does not itself constitute a refund request under our normal refund process.
Where a payment is disputed, reversed, reported as unauthorized, or subject to chargeback, eSIM.day may suspend the affected Service or restrict access to the associated account while the matter is investigated or resolved.
Fees or costs imposed on eSIM.day by a payment processor as a result of an invalid, abusive, or fraudulent payment dispute may be charged to the customer.
Fraudulent, abusive, or repeated payment disputes may result in Service or account restrictions.
Suspension or termination resulting from a payment dispute does not relieve the customer of responsibility for valid outstanding charges.
21. Suspension and Termination
eSIM.day may suspend, restrict, or terminate a Service or customer account, or take other reasonable protective action, where:
- the customer materially or repeatedly violates these eSIM Terms or applicable Plan conditions;
- the Service is used for unlawful, fraudulent, abusive, or unauthorized activity;
- a payment is fraudulent, unauthorized, reversed, or materially disputed;
- continued use presents a material fraud, security, telecommunications, or network risk;
- applicable Fair Use, roaming, security, or technical controls are materially circumvented;
- an applicable mobile network operator, roaming partner, payment provider, or other upstream provider requires or reasonably requests such action; or
- such action is required or reasonably requested by law, a court, judicial authority, law-enforcement agency, regulatory authority, governmental authority, or other competent authority.
Where appropriate and reasonably practicable, eSIM.day may request clarification or corrective action before permanently terminating a Service. Immediate action may be taken where necessary for fraud prevention, security, legal or regulatory compliance, preservation of evidence, or compliance with an authority or upstream provider request.
Services suspended or terminated because of customer violations do not ordinarily qualify for a refund, Store Credit, replacement, extension, or other compensation.
The customer remains responsible for valid outstanding charges and for costs, penalties, fines, claims, or losses arising directly from their violation.
22. Events Outside Our Reasonable Control
eSIM.day is not responsible for Service unavailability, delay, degradation, interruption, or restriction to the extent caused by circumstances outside our reasonable control.
Such circumstances may include natural disasters, war or civil unrest, governmental or regulatory action, telecommunications or Internet outages, power failures, international routing or backbone failures, upstream network or roaming failures, actions of mobile network operators or roaming partners, cyberattacks or major security incidents, labour disputes, trade restrictions, sanctions, or similar events outside our reasonable control.
Where reasonably practicable, eSIM.day may take technical measures to restore or maintain the affected Service, including alternative network configuration, reprovisioning, or other reasonable measures.
Where such circumstances affect the customer's travel arrangements but the purchased Service remains capable of being provided, Section 17 applies.
Where such circumstances cause the purchased Service itself to become materially unusable, any applicable technical remedy or other accommodation will be considered under Section 18.
23. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable law, eSIM.day Services are provided on an "AS IS" and "AS AVAILABLE" basis and, unless otherwise expressly stated, without a Service Level Agreement ("SLA").
Mobile telecommunications connectivity inherently depends on radio conditions, local network infrastructure, device capability, network congestion, international roaming arrangements, routing, traffic management, regulatory conditions, and systems outside eSIM.day's direct control.
We do not warrant that connectivity will be uninterrupted or error-free, available at every geographic location, or provided through a particular operator, speed, latency, signal strength, radio technology, routing path, or IP geolocation.
To the maximum extent permitted by applicable law, Homura Network Limited, eSIM.day, and their directors, employees, and affiliates shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits or revenue, business interruption, missed travel connections, loss of business opportunity, or third-party expenditures.
To the maximum extent permitted by applicable law, the total aggregate liability arising out of or relating to a particular eSIM order or Plan shall not exceed the total fees actually paid by the customer for the specific affected Plan giving rise to the claim.
24. Changes to These eSIM Terms
eSIM.day may alter, modify, or update these eSIM Terms from time to time.
Changes will be published on the applicable policy page with an updated modification or effective date.
Where a material change affects an existing Service or materially changes the customer's rights or obligations, eSIM.day will provide reasonable notice through email, the customer portal, the eSIM.day App or website, or another reasonable communication method.
Revised terms take effect from the stated effective date.
Continued use of an affected Service after that date constitutes acceptance of the updated terms.
If you do not agree with the revised terms, you should discontinue use of the affected Service.
25. Support and Contact Information
Customer and technical support is provided primarily through email (support@esim.day), the eSIM.day ticket system, or support functions made available through the eSIM.day App or customer platform.
Published support hours and response targets are operational targets only and do not constitute an SLA unless otherwise expressly stated.
When contacting support, you should provide sufficient information to identify the affected order and allow the matter to be reasonably investigated.

26. Governing Law and Dispute Resolution
These eSIM Terms are governed by and construed in accordance with the laws of Hong Kong, without regard to conflict-of-law principles.
Customers are encouraged to first contact eSIM.day regarding any concern or dispute so that the matter may be investigated and, where possible, resolved amicably.
The courts of Hong Kong shall have exclusive jurisdiction over disputes arising out of or in connection with these eSIM Terms, subject to any mandatory consumer protection or jurisdictional rights that cannot lawfully be excluded.
27. Severability
If any provision of these eSIM Terms is found to be invalid, illegal, or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.
28. No Waiver
A failure or delay by eSIM.day in exercising any right or remedy under these eSIM Terms does not constitute a waiver of that right or remedy.
A waiver in one particular circumstance does not constitute a continuing waiver or a waiver in any other circumstance.
29. Mandatory Rights
Nothing in these eSIM Terms excludes, restricts, or modifies any right, remedy, liability, or obligation to the extent that it cannot lawfully be excluded, restricted, or modified under applicable law.
30. Language Discrepancy
These eSIM Terms may be made available in multiple languages for convenience.
In the event of any inconsistency, ambiguity, discrepancy, or conflict between a translated version and the English version, the English version shall prevail to the maximum extent permitted by applicable law.
