Acceptable Use Policy (AUP), abuse handling, and network terms applicable to Homura Network virtual servers, web hosting, and NAT.Toys services.

COMPUTE & HOSTING SERVICES POLICY

1. Scope and Customer Responsibility

This Compute & Hosting Services Policy applies to Homura Network virtual servers (VPS), web and application hosting, dedicated servers, NAT services (including NAT.Toys), and other compute and hosting services where this Policy is stated to apply.

Unless otherwise explicitly stated, all services governed by this Policy are provided on an Unmanaged basis. The customer is solely responsible for the installation, configuration, administration, maintenance, and security of the service, including but not limited to operating systems, software, applications, accounts and credentials, firewalls, security patches, data backups, and troubleshooting.

Other services, including software development, software licensing, eSIM or telecommunications services, IP transit, BGP routing services, colocation, and other specialized infrastructure products may be governed by separate or additional agreements. This Policy applies to such services only to the extent expressly stated in the applicable purchase page, service schedule, or agreement.

Where the applicable purchase page or service-specific terms expressly provide different conditions, those more specific conditions take precedence.

Important: You are responsible for securing your server. Any activity originating from or traced back to your server or assigned network resources remains your responsibility, including activity resulting from unauthorized access or system compromise.

2. Prohibited Activities

Spamming and Unsolicited Communication

  • Operating open SMTP relays.
  • Sending unsolicited bulk or commercial messages commonly known as SPAM. Bulk mailings must be based on verifiable opt-in consent; failure to provide verifiable records upon request constitutes unsolicited messaging.
  • Forging or spoofing email headers, sender identities, or routing information.
  • Spamvertising (hosting websites or services advertised via unsolicited bulk email sent from any network).
  • This includes, but is not limited to, email spam, search-engine spam, form spam, or any other form of unsolicited mass messaging.

Content Restrictions

  • Hosting or distributing adult or pornographic content.
  • Hosting, advertising, transmitting, distributing, or displaying child pornography, child sexual abuse material, or obscene material.
  • Hosting or disseminating content that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
  • Hosting or circulating content that unlawfully encourages violence or contains unlawful slanderous or defamatory statements about others.

Financial Misconduct

  • Unauthorized financial transactions or financial platforms.
  • Fraudulent activities, including Ponzi schemes, pyramid schemes, High-Yield Investment Programs (HYIP), fraudulent escrow platforms, and unauthorized multi-level marketing (MLM).
  • Financial platforms operating without licenses or authorisations required by applicable law.
  • Phishing, brand impersonation, payment fraud, credential theft, or other forms of fraud involving financial assets or customer information.
  • Operating unlicensed or illegal gambling, lottery, or casino services.
  • Unauthorized transfer, hosting, uploading, downloading, or distribution of copyrighted or trademarked content (including warez, cracked software, or pirated media).
  • Use of BitTorrent, Private Torrents, or other peer-to-peer (P2P) tools for copyright infringement.
  • Operating services primarily intended to facilitate repeated or systematic copyright infringement (including unauthorized torrent trackers or indexing portals).

Network Attacks

  • Distribution of malicious software, including malware and viruses.
  • Denial-of-service attacks, including DDoS attacks.
  • Operating or participating in botnets.
  • Unauthorized system probing, port scanning, vulnerability scanning, exploitation, or hacking attempts.
  • Brute-force attacks or other attempts to gain unauthorized access.
  • Other malicious network activity reported to our abuse team, an upstream provider, or recorded by network-abuse databases such as AbuseIPDB.

Cryptocurrency Mining

  • Cryptocurrency mining activities are prohibited unless otherwise explicitly mentioned for the applicable service.

Shared Web Hosting Specific Restriction

  • Operating web proxy scripts, open proxies, or public traffic-relaying programs on shared web hosting accounts.

Illegal Activities

  • Engaging in activities that violate laws or regulations applicable to the customer, Homura Network, the contracting entity, or the jurisdiction in which the relevant service is hosted or provided.

Detrimental Activities

  • Activities deemed materially harmful to Homura Network's reputation, operations, network, upstream relationships, or customer relations.
  • Actions contrary to additional codes of conduct, technical restrictions, or service-specific guidelines applicable to the purchased service.

The above list is not exhaustive. Activities substantially similar to those described above may also be restricted where necessary to protect Homura Network, its customers, or its upstream providers.

3. Fair Use Policy

  • Unless otherwise specified, our resources are shared. We kindly ask you to use them responsibly.
  • Customers should regularly monitor resource usage to avoid overburdening shared CPU, memory, storage, or Disk I/O resources.
  • High or abnormal network usage may adversely affect other customers. This includes the use of modified or aggressive high-performance network optimisation, packet-generation, or congestion-control configurations that overload shared infrastructure.
  • Where resource consumption materially affects other customers or platform stability, Homura Network may limit, throttle, pause, or suspend the affected service.
  • Any resource limits, dedicated-resource commitments, bandwidth conditions, or other specifications stated on the applicable purchase page take precedence over this section.

4. Abuse Handling

Abuse incidents include, but are not limited to:

  • Network Attacks;
  • Copyright Violations;
  • Spamming and Unsolicited Communication; and
  • Miscellaneous violations of this Policy or applicable service terms.

Upon detecting a credible abuse incident or receiving a credible abuse report, the affected service may be suspended immediately.

Unless otherwise specified in the applicable abuse notice, the customer has two (2) business days to respond, clarify the incident, and complete any required remediation.

Homura Network may conduct technical investigations where reasonably necessary.

The customer is responsible for legal consequences, damages, charges, or fines resulting from activities associated with the customer's service.

Intentional violations may result in termination of all related services. Repeated violations may result in termination of all services associated with the customer and closure of the customer account without refund.

Where an abuse incident results in an abuse-related fee, processing charge, investigation charge, penalty, or similar amount being imposed on Homura Network by an IP provider, data center, carrier, or other upstream provider, Homura Network reserves the right to issue a corresponding charge or invoice to the customer.

Homura Network also reserves the right to assess reasonable administrative handling fees and report relevant abuse intelligence to reputable security feeds and Real-time Blackhole Lists (RBLs, including Spamhaus and AbuseIPDB).

Services associated with the abuse incident may remain suspended until the applicable charge and abuse case have been resolved.

In cases of severe violations, Homura Network reserves the right to terminate the affected service without refund.

For verification or anti-fraud purposes following an abuse incident, Homura Network may require additional identity or account verification and may use appropriate third-party verification platforms.

Where a system appears to have been compromised, customers are expected to secure the affected system and take reasonable measures to prevent recurrence. Use of SSH-key authentication, secure credentials, software updates, and restricted administrative access is strongly recommended.

A compromised system does not exempt the customer from responsibility under this Policy. Activities traced back to the customer's server or assigned network resources will be treated in accordance with Section 1.

5. Proactive Network and Abuse Measures

Homura Network respects customer privacy and does not undertake unnecessary intrusive monitoring. However, reasonable technical measures may be used to protect network integrity and reduce abuse.

  • SMTP Port Policy: Outbound SMTP ports, including 25, 465, and 587, may be blocked by default. Requests to open supported SMTP ports may be submitted through the support ticket system. Approval is not guaranteed and SPAM remains strictly prohibited regardless of port availability.
  • Firewall Monitoring: Firewalls and other network protection systems may identify or restrict abnormal traffic patterns. False positives may occur. If legitimate traffic appears to have been blocked, customers may contact support.
  • Resource Usage Monitoring: Unusual CPU, memory, Disk I/O, packet, or network usage may indicate a compromised system, abusive workload, or other problem. Automated systems may notify, limit, pause, or suspend services where necessary to protect service stability.
  • Additional Port Restrictions: Other ports may be blocked or restricted depending on the product, location, network, or upstream provider.
  • Specific Service Restrictions: Certain service packages may restrict Port 22 or other management ports as stated on the applicable purchase page.

The availability or opening of a port does not constitute permission to use it in violation of this Policy.

6. IP Replacement Policy

We do not guarantee accessibility of assigned IP addresses through third-party networks, firewalls, filtering systems, or jurisdictional filtering systems, including the Great Firewall.

Unless otherwise specified for the applicable product or package, where an assigned IP address is inaccessible upon initial service delivery, we provide up to two (2) complimentary random IP replacements within twenty-four (24) hours.

After the initial twenty-four-hour period, or after the two complimentary replacements have been used, eligible IP replacements are charged at:

  • US$3.00 (USD); or
  • HK$19.00 (HKD)

per replacement, with a minimum interval of fifteen (15) days between replacements.

IP replacement is intended for accessibility issues. Replacement IP addresses are assigned randomly.

Customers should request an IP replacement by opening a support ticket. Proof of inaccessibility, such as results from an appropriate online ping, traceroute, or connectivity test, is highly recommended.

Where an IP address becomes inaccessible as a result of customer-installed software, scripts, firewall configuration, operating-system configuration, or other customer-controlled changes, the customer should use available VNC, console, rescue, or operating-system reinstallation functionality to troubleshoot the issue.

Unless otherwise explicitly mentioned, Homura Network does not provide technical support for customer software or configurations causing such accessibility problems.

The IP replacement eligibility period is calculated from the time the IP address is assigned to the service until the time the corresponding support ticket is opened.

Certain products or packages may not support IP replacement or may be subject to different replacement conditions as expressly stated on the applicable purchase page.

7. VPS and Hosting Refund Policy

Unless otherwise specified for the applicable product, customers purchasing eligible standard VPS and shared-hosting services may request a refund within twenty-four (24) hours after initial activation.

Refund eligibility is determined according to the time at which the refund ticket is submitted.

The standard refund policy does not apply where:

  1. the customer has violated the Terms of Service, this Policy, or other applicable terms;
  2. outbound data transfer exceeds 30 GB;
  3. the assigned IP address has been changed after use;
  4. the customer has repeatedly purchased services and requested refunds in a manner reasonably considered abusive; or
  5. the applicable purchase page states that the product is not eligible for refund.

Dedicated servers, special promotional products, and other products may be subject to separate refund conditions stated on their respective purchase pages.

Where an eligible service remains continuously offline for more than forty-eight (48) hours due solely to Homura Network's responsibility, the customer may request compensation or a refund proportional to the remaining service period, unless otherwise specified by the applicable service terms or SLA.

Approved refunds are processed in accordance with the refund provisions of the Terms of Service.

8. Special Terms for NAT.Toys

8.1 Scope

This Section applies to NAT.Toys and to any NAT, shared-IPv4, or IPv6-only service expressly identified on the applicable purchase page, service schedule, or other applicable terms as being subject to this Section.

8.2 No SLA, Refunds, or Standard Compensation

Unless otherwise expressly stated on the applicable purchase page, services subject to this Section are provided without a Service Level Agreement (SLA) and are excluded from the standard refund policy, outage compensation policy, and IP replacement policy.

Once activated, such services are non-refundable.

8.3 Network Configuration

NAT or shared-IPv4 services may provide public network connectivity through shared public IPv4 addressing and port forwarding rather than a dedicated public IPv4 address.

IPv6-only services do not include a dedicated public IPv4 address.

The number and availability of forwarded ports, address families, and other network features are determined by the applicable service configuration and purchase page.

8.4 External Reachability

Homura Network does not guarantee that IP addresses or network services provided under this Section will be reachable from every country, region, carrier, Internet service provider, or third-party network.

Accessibility may be affected by third-party filtering systems, firewalls, routing conditions, network policies, or other circumstances outside Homura Network's control, including network conditions in Mainland China.

8.5 Limited Support

NAT.Toys is provided with limited technical support.

Support requests are handled through the ticket system on a reasonable-efforts basis, with an ordinary target response time of seven (7) business days.

The target response time is non-binding and does not constitute an SLA, guaranteed response time, or other service commitment.

For services subject to this Section, this provision supersedes any general support response target stated elsewhere in the Terms of Service or applicable policies.

8.6 Network and Port Restrictions

Homura Network may impose outbound port, protocol, destination, rate, or other network restrictions where reasonably required for security, abuse prevention, upstream compliance, or network integrity.

Restricted destination ports may include, without limitation:

21, 22, 23, 25, 465, 587, 3389, 5900–6000, 6660–6667

Such restrictions may vary depending on network location, upstream provider, security requirements, service configuration, or other operational circumstances.

The availability of a port or protocol at any particular time does not constitute a guarantee that it will remain unrestricted.

8.7 SSH and Port Forwarding

Because NAT services use port forwarding, standard external TCP Port 22 may not be available.

Where applicable, customers must use the external forwarding port assigned through the relevant management interface to access SSH or other internally hosted services.

8.8 Intended Use

NAT.Toys is designed primarily for development, testing, experimentation, personal applications, and other non-critical workloads.

Unless otherwise expressly stated, services subject to this Section do not include any commitment regarding high availability, business continuity, production suitability, or uninterrupted operation.

8.9 Order of Precedence

Where this Section directly conflicts with another provision of this Policy, this Section shall prevail with respect to services subject to it.

Any more specific restriction, entitlement, or service condition expressly stated on the applicable purchase page or service schedule shall take precedence over this Section to the extent of the direct conflict.

9. Service Transfer Policy

  • Eligible Service Transfers: Service transfers between customer accounts are subject to an administrative transfer fee of US$2.00 (USD) or HK$10.00 (HKD) per transfer unless otherwise explicitly mentioned for the applicable product.
  • Pre-Conditions for Transfer:
    • Before a transfer can be processed, all outstanding invoices relating to the affected service and account must be settled in full.
    • Services with active abuse incidents, unresolved payment disputes, fraud flags, or other account restrictions may not be transferred.
  • Standard Transfer Procedure:
    1. The recipient opens a support ticket containing the service/package name, applicable specifications, bandwidth or transfer allocation where relevant, and recurring renewal fee.
    2. The current owner opens a corresponding support ticket containing the recipient's registered account email address, service/package details, recurring renewal fee, and Service ID.
    3. An administrative transfer fee invoice will be issued where applicable.
    4. The transfer will be executed after required verification and invoice settlement.
  • Post-Transfer Responsibility: Following completion of the transfer, the recipient assumes full legal, financial, and operational responsibility for the service and for any use or abuse incidents occurring after the transfer date.
